Terms & Conditions for Agentura Digitalis (and associated websites)

By using any of the services on our websites (agenturadigitalis.com, ellaluna.digital, and elladigitalis.com), you agree to these Terms & Conditions. Please read them carefully before proceeding.

I, Ella Luna Digitalis, am the sole proprietor of Agentura Digitalis, based in Switzerland. All services and products offered through our websites are provided by Agentura Digitalis.

2. Services Provided

We provide a range of services including, but not limited to:

Graphic design services
Web design and development
Funnel creation and marketing strategy consultations

By purchasing any service, you are agreeing to the terms outlined below and any additional service-specific agreements provided during the order process.

3. Use of Third-Party Services

To deliver our services efficiently, we use several third-party providers, including:

Stripe and PayPal for secure payment processing.
WordPress for hosting websites and services.
Elementor for website building.
GoHighLevel for customer management and communication tools.

By engaging with our services, you agree to the terms and privacy policies of these third-party services. We encourage you to review their terms of service:

We are not responsible for the data handling practices of these third-party services, but we ensure that your data is only shared with them as necessary to complete your transaction.

4. Payments and Refunds

All payments are securely processed through Stripe or PayPal. Upon purchase, your payment will be processed immediately.

Refund Policy: Refunds are not available once the design process has begun or after delivery of services unless explicitly agreed upon in writing.

Minimum Subscription Period: For services provided on a subscription basis, such as ongoing graphic design retainers or digital services, we require a minimum subscription commitment of two months. If you wish to cancel your subscription after the minimum period, you must provide two weeks’ notice before the next billing cycle.

Please note that refunds will not be provided once a billing cycle has begun.

5. Delivery of Services

For all graphic design services, the standard delivery time is 7 days. For more complex services like web design or funnel creation, the delivery time is up to 2 weeks.

Fast Delivery Options:

2-Day Rush: Double the service cost
3-Day Delivery: 1.5x the service cost
4-Day Delivery: 1.25x the service cost

6. Intellectual Property

Upon payment completion, you receive full rights to the final designs delivered to you. Original design files (e.g., PSDs) are not provided unless purchased as an additional service.

7. Privacy Policy

Your data privacy is important to us. We adhere to Swiss data protection laws and the EU’s GDPR where applicable. We do not share your personal information with third parties other than those required to fulfill our services (i.e., payment processors and hosting providers).

8. Liability

We are not liable for any issues arising from the use of our third-party providers, including any disruptions or failures in payment processing or web hosting. By using our services, you agree that we are not responsible for any losses incurred due to third-party actions.

9. Amendments

We reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page, and continued use of our services implies acceptance of the revised terms.
